Information on data transfers to the USA

This website uses, among other things, tools from companies based in the USA. When these tools are active, your personal data may be transferred to the USA and processed there.

Please note that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary to fulfil a contract, if we are legally obliged to do so (e.g. transfer of data to tax authorities), if we have a legitimate interest in the transfer pursuant to Art. 6(1)(f) GDPR or if another legal basis permits the transfer of data. When using processors, we only pass on our customers' personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

For this purpose, the service provider is given access to the data processed in these services. We remain the owner of the respective accounts and the controller within the meaning of the GDPR.

The service provider processes the data exclusively in accordance with our instructions and not for its own purposes. The service provider does not pass the data on to third parties. If the service provider uses other providers for individual services (sub-processors), this is done only with our approval and on the basis of corresponding data processing agreements.

The service provider is engaged within the scope of the legal bases stated in this privacy policy. In addition, we have a legitimate interest in the competent, secure and reliable support of our website (Art. 6(1)(f) GDPR).

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.

  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.

  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our website uses so-called "cookies". Cookies are small data packages and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to analyse user behaviour or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested (e.g. the shopping cart function) or to optimise the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Information on any further cookies and services used on this website can be found in this privacy policy.

Consent with Cookiebot

Our website uses consent technology from Cookiebot to obtain your consent to the storage of certain cookies on your device or to the use of certain technologies and to document this in compliance with data protection law. The provider of this technology is Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark (hereinafter "Cookiebot").

When you enter our website, a connection is established with the Cookiebot servers to obtain your consent and other declarations regarding the use of cookies. Cookiebot then stores a cookie in your browser in order to be able to assign the consents given or their revocation to you. The data collected in this way is stored until you ask us to delete it, delete the Cookiebot cookie yourself or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

Cookiebot is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Cookiebot is set up and managed on our behalf by our service provider for the technical support of the website (see section "Technical support of the website"). Usercentrics is involved as a sub-processor. Processing is carried out on the basis of data processing agreements which ensure that your data is processed only in accordance with our instructions and in compliance with the GDPR.

Enquiry form for product enquiries

On this website, we offer a multi-step enquiry form that you can use to send us product enquiries. The information you provide in the individual steps (e.g. desired products, documents and requirements, name, company, e-mail address, telephone number and your message) is processed for the purpose of handling the enquiry and in case of follow-up questions. We will not pass on this data without your consent.

The enquiry form is provided and operated by our service provider for the technical support of the website (see section "Technical support of the website"). Your entries are processed on a server in Germany (Nuremberg) and transmitted to us. No transfer to third countries takes place.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if this has been requested; consent can be revoked at any time.

The form data stored on our service provider's server, including uploaded documents, is used exclusively to transmit your enquiry to us. It is automatically deleted 14 days after we have retrieved it, but no later than 6 months after receipt of the enquiry. Enquiries received by us remain with us until you ask us to delete them, revoke your consent to storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

Enquiries by e-mail or telephone

If you contact us by e-mail or telephone, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request. We will not pass on this data without your consent.

The data you send to us via contact requests remains with us until you ask us to delete it, revoke your consent to storage or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Handling of applicant data

We offer you the opportunity to apply to us. As long as we have advertised vacancies, an online application form is available for this purpose. Otherwise, you can send us your application by e-mail or by post. In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process the associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary for the decision on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG (German Federal Data Protection Act) under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation) and, if you have given your consent, Art. 6(1)(a) GDPR. Consent can be revoked at any time. Within our company, your personal data will only be passed on to persons involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

As part of the application process, we may also carry out an internet search on you. This mainly includes Google search, LinkedIn and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly available information about you in accordance with Art. 6(1)(f) GDPR.

Data retention period

If we are unable to offer you a position, if you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), it will only be deleted when the purpose for further retention no longer applies. Longer retention may also take place if you have given your consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and information from the application are transferred to the applicant pool in order to contact you in the event of suitable vacancies. Inclusion in the applicant pool is based exclusively on your express consent (Art. 6(1)(a) GDPR). Giving consent is voluntary and has no bearing on the ongoing application process. The data subject can revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are statutory reasons for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.
